ESR photo Research project "Health Data Governance in the Age of Digital Health: The Legal Models of the EU and China" About the project While the emergence of AAL technologies within the context of healthcare present incredible opportunities to improve the life quality of the frail and sick, these technologies pose significant legal issues. These technologies require coherent legal regulation in order to ensure, among other things, the safety of the device and the privacy of the individual using it. Taking a global perspective, this project will explore the current legal framework governing video-based AAL technologies and involve an in-depth interpretation and systematization of the positive law related to this emerging field. While the bulk of the work will involve a deep dependence on traditional legal sources, reliance on materials gathered in the domain of computer science and a translation of these materials into a legal context will be necessary. Start date: April 2021 Progress of the project Zhicheng He’s doctoral project entails a comparative legal study between the health data protection legal framework of the European Union (EU) and that of China, in the context of using digital technologies for health-related purposes, with a focus on assisted living. Outcomes are expected to be presented in a monograph, which seeks to map the complex legal framework applicable to digital health technologies in the context of health data processing. During the past period, Zhicheng has made an updated research plan with detailed steps to achieve the goal. His works are proceeding as planned. Manuscripts on the introduction and technology sections of the thesis have been generated. He is now conducting research on the data protection legal frameworks of the EU and China. So far, Zhicheng has presented his research within visuAAL in four international conferences. In 2022, he published part of his research in one paper, for which he also received the “Best Workshop Student Paper Award” in PETRA 2022. In addition to thesis works, Zhicheng has been active in the research community, especially the GoodBrother research network. He co-authored both the Whitepaper on AAL (published) and the position paper (to be published). Besides, Zhicheng attended all trainings within visuAAL and finished three PhD courses at Stockholm University (22.5 ECTs). About the ESR Zhicheng is interested in exploring the interaction between law and information technology. He completed his Master of Laws in International Business Law (LL.M.) at Ghent University (Belgium) where he dedicated his thesis to personal data protection. He holds another Master of Laws degree and a Bachelor of Laws degree, both from Southwest University of Political Science and Law (China). Before his position in visuAAL, Zhicheng worked as an in-house legal counsel and gained practical experience in the ICT sector.
